New EU-Law Article from ANUCES

PhD Candidate Ivana Damjanovic and Prof Ottavio Quirico, have a new article published in the Columbia Journal of European Law Vol. 26, No. 1, 2019. Pp. 102-156 (published Feb 2020). The article, 'Intra-EU Investment Dispute Settlement under the Energy Charter Treaty in Light of Achmea and Vattenfall: A Matter of Priority', analyses the claim of Vattenfall, a Swedish energy company, against Germany's decision to phase out nuclear energy in reaction to 2011 Fukushima nuclear incident. Vattenfall v Germany serves as a case study for explaining controversial issues of applicable law and jurisdiction in intra-EU investment disputes under the Energy Charter Treaty, and it is discussed in light of recent developments in the field of international investment and EU law.
